About these terms
FlightPayback is operated by ClinSol Services Inc., a company incorporated in Ontario, Canada ("we", "us"). These terms apply when you use this website. By using it, you agree to them. If you don't agree, please don't use the site.
What FlightPayback does
FlightPayback compares the answers you give about a delayed or cancelled flight with Canada's Air Passenger Protection Regulations and tells you whether compensation may be owed and how much. We prepare information and documents that you send. We do not act for you: we don't contact airlines on your behalf, negotiate, collect money or go to court.
Not legal advice
Everything on this site is general information. It is not legal advice, and using the site doesn't create a lawyer-client relationship. If you need advice about your situation, speak to a lawyer, or contact the Canadian Transportation Agency.
Results are estimates
- Your result depends on the answers you give. If an answer is wrong or incomplete, the result may be wrong.
- Whether compensation is owed often depends on facts only the airline has, such as the real cause of a delay, which may only be confirmed later.
- The airline decides whether to pay. If it refuses, the Canadian Transportation Agency can decide a complaint.
- Our rules follow the regulations as published when we last checked them. Laws change, and we update the site when they do.
We don't guarantee that you will receive any payment.
Using FlightPayback through an AI assistant
When you use FlightPayback through an AI assistant, the assistant passes your answers to us and shows you our result. Assistants can misunderstand or mistype answers, and we only see what they send, so check the result against your own flight details. The assistant is provided by another company under its own terms; we're not responsible for what it says beyond the result we return. The same limits apply: our result is general information, not legal advice.
Your responsibilities
- Answer accurately and honestly, and only check flights you or the people you're helping were booked on.
- Keep track of deadlines. A compensation request must reach the airline within one year of the delay or cancellation.
- Don't use the site to make false or misleading claims.
Paid features
The free check is free. Our paid claim pack isn't available yet. When it is, its price and any extra terms (including refunds) will be shown before you pay.
Acceptable use
Please don't:
- send automated or bulk requests, or copy ("scrape") the site's content or data;
- try to disrupt the site, get around its security, or access parts of it you're not meant to;
- use the site for anything unlawful.
Our content
The site's design, text and software belong to us. The regulations themselves are public law. You're welcome to share links to the site.
Links to other sites
We link to other sites, such as government pages. We're not responsible for their content or how they handle your information.
Changes and availability
We may change, pause or stop parts of the site at any time. We'll do our best to keep it available and accurate, but we can't promise it will always be error-free or uninterrupted.
Limits on our liability
The site is provided "as is". To the extent the law allows, we're not responsible for indirect or consequential losses, or for compensation an airline doesn't pay. To the extent the law allows, our total liability to you is limited to the greater of the amount you paid us for the service concerned and CAD 100. Nothing in these terms limits rights you have under consumer protection laws that can't be excluded by agreement.
Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes will be heard by the courts of Ontario, unless the consumer protection law of your province gives you the right to bring them where you live.
Changes to these terms
We may update these terms. We'll change the date at the top, and the version in effect when you use the site applies.
